WHAT IS IT?
An ALR Hearing is a civil proceeding that occurs when the Department of Public Safety is attempting to suspend your driver's license because you either;
1) refused to submit to a breath or blood test at the time you were arrested for a DWI, or 2) you failed the breath or blood test at the time of your arrest for DWI.
HOW WOULD I KNOW ABOUT THIS?
When you were arrested for DWI the police officer advised you of your right to submit to the breath/blood test or refuse to submit to the test. Also, you would have been informed of the consequences if you refused to submit to the test.
WHY SHOULD I REQUEST AN ALR HEARING?
First, if the attorney for DPS cannot prove their case then your driver's license would not be suspended for the initial refusal or failure of the test.
Also, this hearing would provide your attorney with a more complete view of the State's case against you and be a valuable tool in deciding how to proceed with your criminal DWI case.
HOW DO I REQUEST AN ALR HEARING?
You should have received information about who to contact when you received your "Notice of Suspension". If you do not have the form then go to the FORM section I have provided on this web page.
WHAT IF I DON'T REQUEST AN ALR HEARING WITHIN 15 DAYS?
If you fail to request a hearing on the fortieth day from the date you received Notice of Suspension your license will be suspended automatically. |
